Hold Harmless Agreement for The Honest Horsewoman - MUST be signed by all participants BEFORE participating in an equestrian activities.
I (PARTICIPANT or GUARDIAN of Participant) hereby acknowledge that I am freely and willingly entering into an agreement with Kelli Murphy of The Honest Horsewoman in Killingworth, Connecticut, herein referred to as “THHw.”
I understand the potential dangers that may occur in interacting with a horse, including, but not limited to, the tendency of horses to, without warning or apparent cause, buck, kick, bite, rear, stumble, fall, spook or make unanticipated movements, jump obstacles in their path, step on a person’s foot, or push or shove a person, and saddles or bridles may loosen or break, all of which may result in injury or even death.
Understanding those risks I hereby release that THHw, its owners, members, shareholders, employees and anyone else directly or indirectly connected with that THHw from any liability whatsoever in the event of injury or damage of any nature (including death) to me or anyone else caused by or incidental to my electing to interact with a horse from or at, but not necessarily owned by, The Honest Horsewoman (THHw).
I understand that Connecticut General Statutes p.52-557 “Assumption of risk by person engaged in recreational equestrian activities” states:
“Each person engaged in recreational equestrian activities shall assume the risk and legal responsibility for any injury to his person or property arising out of the hazards inherent in equestrian sports, unless the injury was proximately caused by the negligence of the person providing the horse or horses to the individual engaged in recreational equestrian activities or the failure to guard or warn against a dangerous condition, use, structure or activity by the person providing the horse or horses or his agents or employees.”
I (PARTICIPANT or GUARDIAN of Participant) , the undersigned have read and understand, and freely and voluntarily enter into this Release and Hold Harmless Agreement with The Honest Horsewoman (THHw), understanding that this Release and Hold Harmless Agreement is a waiver of any and all liability(ies).
